RTA Assault Victim Leaves Behind 3 Children, Suspect Released

UPDATE -- The man arrested for the assault at the downtown Dayton RTA hub is released from custody.

Bartholomew Snow was caught on tape assaulting Matthew Gutierrez, 29. Gutierrez walked away from the scene but died three days later. Police arrested snow on assault charges.

The Montgomery County Coroner's Office declined to file charges against Snow until more information is available in the case. Officers released him from custody Wednesday night pending police reports on the incident and toxicology test results.



DAYTON -- Matthew Gutierrez's family members are heartbroken.
"We have to bury him right before Christmas." Gutierrez's sister Samantha Wilson said.   

His family said Matthew  was beaten in the head and face  at the RTA Hub on Main Street on Friday and ended up dying from his injuries in the hospital on Monday.
 
Police arrested Bartholomew Snow on assault charges,  but he could  face different charges  when the case is presented to the Montgomery County Prosecutor's Office.       

"I hope he spends  the rest of his life in jail.  He took a great man, a hard working, a great father." Wilson said. 

His family said Matthew  leaves behind  his fianc Kyffin and his three  children,  Conner, Carson and Caleb.
    
His family said  Christmas will be especially tough this year for his boys and fianc and  are trying to collect  toys  for his kids.      

"We just want the kids to have a great Christmas.  We want Kyffin to be able to  take care of the kids. It's all about the kids that's what it's all about."  Matthew's brother  Frank Gutierrez said.
   
His family said  Matthew struggled with an addiction problem and was 90 days clean.   He had a contractor job and was working on turning his life around.
 
"All he wanted to do was get his family  back together and get a place." Wilson said. 
   
Anyone that would like to contribute toys to these boys, ages 18 months, three, and eight,  can drop off toys at  donation boxes located at the Germantown Subway and Germantown Fresh Market both on Dayton Germantown  Pike.
