Attorney General Files Lawsuit Against Dayton Door-to-Door Magazine Seller
DAYTON -- Ohio Attorney General Mike DeWine today announced a lawsuit against POSuccess LLC of Dayton and its owner Princesa Brown for failing to deliver magazine subscriptions sold to consumers.
Consumers wrote checks to this business for magazine subscriptions they never received, Attorney General DeWine said. This is another reminder of why its important to research door-to-door salespeople before giving them any money.
DeWine says Princesa Brown ran POSuccess from her home in Dayton. The business reportedly offered magazine subscriptions through door-to-door sales to consumers. Consumers paid $30 to $554 for the subscriptions, but the magazines never arrived, DeWine said. The Ohio Attorney General's Office and Better Business Bureau received 23 complaints against the business.
Although the business resolved some consumer complaints by providing refunds, DeWine said other complaints went unresolved.
The lawsuit charges the business and Brown with violating Ohio's Consumer Sales Practices Act and Home Solicitation Sales Act. Specific counts include failure to deliver and failure to provide notice of consumers three-day right to cancel. In the lawsuit, Attorney General DeWine seeks consumer restitution, civil penalties, and injunctive relief.
DeWine reminds consumers to get information in writing and to research businesses with the Ohio Attorney General's Office and Better Business Bureau before making any payments.
For most door-to-door sales, consumers have three business days to cancel a contract they sign in their homes. Under the Home Solicitation Sales Act, the seller must give consumers notice of their right to cancel.
